1. Acceptance of these terms
These Terms & Conditions (“Terms”) are a legal agreement between you and BrokerSaab LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008 (LLPIN ADC-5123) with its registered office at Flat No. C6-504, Phase 2, Nere, Pirangut, Hinjawadi Phase 1, Mulshi, Pune - 412115, Maharashtra, India (“BrokerSaab”, “we”, “us”) for your use of our website (www.brokersaab.com), mobile application and related services (the “Platform”). By ticking the acceptance box, creating an account or using the Platform, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
This is an electronic record under the Information Technology Act, 2000 and does not need a physical or digital signature.
2. Who is who
- Owner: a person who owns or is authorised to rent out a property listed or managed on the Platform.
- Tenant or Resident: a person who rents, or is applying to rent, a room, bed or property.
- In-Charge or Staff: a warden, manager or other person an owner invites to run a property.
- Guardian: a parent or guardian linked to a resident, for example of a student or a minor.
- User: any of the above, and anyone else who uses the Platform.
3. Eligibility and your account
- You must be at least 18 years old, legally able to enter a contract, and use a mobile number that belongs to you.
- You log in with a one-time password sent to your mobile number. You are responsible for everything done through your account, so keep your phone and OTP private.
- You must give accurate, current and complete information and keep it up to date. One person may not hold multiple accounts to evade a restriction.
- We may refuse, suspend or close an account that gives false information, is used unlawfully or breaks these Terms.
4. Our role
BrokerSaab provides technology and tools that make property management hassle-free: listings, tenancy and room management, agreements, KYC, payment requests and tracking, notices, reminders and support tickets. Unless we agree otherwise with you in a separate written agreement:
- We are an intermediary platform. We are not a party to the rental agreement between an owner and a tenant, and we are not the landlord, tenant, employer of property staff, bank, payment aggregator or escrow agent.
- Where the Platform helps you find or connect with an owner, tenant, agent or other service provider, we facilitate the introduction. The arrangement that follows is between you and that person.
- Owners are responsible for their properties, rent terms and compliance with law. Tenants are responsible for their conduct and payments.
- Where our team verifies a property or a person, that is a check on the information provided at that time. It is not a guarantee of title, quality, safety, character or future behaviour.
5. Listings and property information
If you list or manage a property, you confirm and promise that:
- you own it or have legal authority to rent it out, and the information, photos, price, facilities and rules you provide are true and not misleading;
- the property and your letting comply with applicable law, including rent, registration, building, fire and safety rules and, where relevant, RERA and local police verification requirements;
- you will update availability, rent and details promptly and will not list the same property deceptively or collect money for a property you cannot let.
Listings go through our verification before they are shown publicly. We may edit, reject, hide or remove a listing that is inaccurate, unlawful or harms users, and we are not obliged to list any property.
6. Tenancy management features
The Platform lets owners and in-charges add residents, assign rooms and beds, record rent and deposit, generate and store rental agreements (including electronic signing), run room-inventory checks, approve room transfers, post notices, send reminders, split electricity bills, handle support tickets, and process move-out and deposit refunds. Residents can view their tenancy, pay and track dues, raise requests and confirm outcomes.
These tools record and organise what the parties agree. The owner and tenant remain bound by their own rental agreement. A rental agreement generated on the Platform is a convenience document; the parties should read it carefully, make sure it meets the requirements of law (including stamp duty and registration where applicable) and take legal advice if needed.
7. KYC and identity verification
- We may ask owners, tenants, members and in-charges to verify identity with PAN, Aadhaar and, where required, other documents or police verification.
- Aadhaar verification is done through the Government of India’s DigiLocker with your consent. We do not store your full Aadhaar number. See the Privacy Policy for details.
- You must submit only genuine documents that belong to you. Submitting forged, altered or someone else’s documents is a serious breach and may be reported to the authorities.
- Owners and in-charges must use KYC data only to manage the tenancy and meet legal duties, keep it confidential, and not copy, share or sell it. The owner is responsible for complying with any local police tenant-verification requirement for their property.
- We may refuse to complete a tenancy or restrict an account where verification fails or cannot be completed.
8. Rent, deposits and payments
Important
- How payment works. An owner or in-charge raises a payment request. The tenant pays the owner’s account by UPI or bank transfer, or through online checkout that uses the owner’s own payment-gateway account. For offline payments the tenant uploads proof and the owner, in-charge or our staff approve or reject it.
- Confirmation. An online payment is marked paid once the gateway’s confirmation is verified. An offline payment is marked paid only when approved. A payment you have made but that is not yet approved is shown as awaiting approval. Keep your bank or UPI receipt until it is approved.
- Charges and late fees. Rent, deposit, electricity, maintenance and other charges, any grace period and any late fee are set by the owner, must be disclosed to the tenant, and must be lawful. We apply them as configured; we do not set or guarantee them.
- Security deposit. The deposit is held by the owner. It must be returned after move-out, less lawful and documented deductions, as per the rental agreement. The Platform tracks the refund request, deduction and the tenant’s confirmation.
- Payment risks. Gateways, banks and UPI apps are run by third parties. We are not responsible for failed, delayed, duplicate or wrongly addressed transfers, or for a gateway’s fees. Check the beneficiary name and details before you pay.
- Taxes. Each party is responsible for its own taxes, including income tax, GST where applicable and any tax deducted at source on rent.
9. Platform fees and premium features
Many features are free. We may offer some features as paid or premium, or limit them by plan, and we may change which features are free or paid. If a feature becomes chargeable, we will show the price and terms before you pay. Fees are exclusive of applicable taxes and, unless stated at purchase or required by law, are non-refundable. Access to a feature can be restricted or withdrawn, with notice where practicable, for a user, a property or a user type.
10. Responsibilities of owners and in-charges
- Rent only what you are legally entitled to rent, on terms you have clearly disclosed, and keep the property safe and habitable.
- Treat tenant data, including KYC, with confidentiality and use it only for the tenancy. Do not disclose it except as law requires.
- Record payments, approvals, notices and refunds honestly and promptly, and respond to resident requests and tickets in reasonable time.
- Give notice and return deposits as the rental agreement and law require. Do not evict, lock out, or withhold belongings or deposits unlawfully.
- Owners remain responsible for the acts of the in-charge and staff they appoint, and for their wages and statutory duties as employer.
11. Responsibilities of tenants and residents
- Provide true identity and contact details and genuine KYC documents.
- Pay rent and other lawful charges on time, as agreed, and keep proof of payment.
- Use the property only for the agreed purpose, follow house rules and the law, respect neighbours and other residents, and not damage the property.
- Give notice and complete move-out and inventory checks as the agreement requires, and confirm receipt of any deposit refund honestly.
- Do not sublet, or let others stay, in breach of the agreement.
12. Communications you agree to receive
You agree that we and the owner or in-charge of your property may contact you by in-app notification, SMS, voice call and email for OTPs, rent and payment reminders, notices, request and agreement updates, security alerts and support. These service messages are essential to the Platform. You are responsible for keeping your contact details current. Standard carrier charges may apply.
13. Acceptable use
You must not:
- break any law, or use the Platform for fraud, money laundering, harassment, discrimination, or any illegal activity;
- provide false information, forged documents or impersonate any person;
- harvest or scrape other users’ personal data, or use it for any purpose other than the tenancy it was shared for;
- upload malware, probe or test the security of the Platform, scrape it, or interfere with its operation or other users;
- post content that is unlawful, defamatory, obscene, infringing or that violates privacy;
- use the Platform to take payments or to run business for a property you have no right to manage.
14. Your content
You keep ownership of the photos, documents, reviews and other content you upload. You give us a non-exclusive, worldwide, royalty-free licence to host, store, display, process and share it as needed to run the Platform for you and the other users of your property, and to keep records as required by law. You confirm you have the right to upload it. We may remove content that breaks these Terms or the law. Reviews must be honest and based on real experience.
15. Our intellectual property
The Platform, its software, design, text, logos and the BrokerSaab name are owned by BrokerSaab LLP or its licensors and are protected by law. You get a limited, personal, non-transferable, revocable right to use the Platform as these Terms allow. You may not copy, modify, reverse-engineer or resell it.
16. Third-party services
The Platform works with third-party services such as DigiLocker and identity-verification partners, payment gateways, banks and UPI apps, telecom and email providers and cloud hosting. Their own terms and privacy policies apply to what they do. We are not responsible for their availability, errors or acts, though we choose providers carefully.
17. Disclaimers
- The Platform is provided “as is” and “as available”. We work to keep it reliable and accurate but do not promise it will be uninterrupted or error-free.
- We do not guarantee the availability, condition, legality or suitability of any property, or the identity, solvency, honesty or conduct of any user.
- Information such as distances, photos, amenities and prices is supplied by owners and may change. Please verify it yourself before deciding.
- Nothing on the Platform is legal, tax or financial advice.
18. Limitation of liability
To the fullest extent permitted by law, BrokerSaab LLP, its partners, employees and affiliates are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, rent, deposit, data or goodwill, or for any loss arising from the acts or omissions of owners, tenants, in-charges or other users, or of third-party providers, or from events beyond our reasonable control.
Where liability cannot be excluded, our total liability to you for all claims relating to the Platform is limited to the amount you paid us for the Platform in the twelve months before the claim arose, or ₹5,000 if you paid us nothing. Nothing in these Terms limits liability that cannot be limited by law, or any right you have under consumer protection law.
19. Indemnity
You agree to indemnify and hold harmless BrokerSaab LLP and its partners, employees and affiliates against claims, losses and reasonable costs (including legal fees) that arise from your breach of these Terms or the law, your content, the information or documents you provide, or your dealings with another user.
20. Suspension, termination and deleting your account
You may stop using the Platform and ask us to delete your account at any time (see the Privacy Policy and our Delete Account page). Closing an account does not cancel any rent, deposit or other obligation you already have to another user. We may suspend or end your access, with notice where practicable, if you break these Terms or the law, put others at risk, or if we must by law. Clauses that by their nature should survive, including those on payments owed, liability, indemnity and disputes, continue after termination.
21. Disputes and governing law
Between owners and tenants
Disputes about rent, deposit, deductions, damage, notice, eviction, agreement terms or conduct are between the owner and the tenant and are governed by their rental agreement and the law. The Platform helps by keeping clear records (payment history, approvals, inventory checks, tickets, refund requests and agreements) and by letting you raise a ticket, a deposit-refund dispute or a request. Our team may offer good-faith help to the parties to reach a settlement, but we are not an arbitrator or a court, we do not decide who is right, and our suggestions do not bind anyone.
Between you and us
If you have a complaint about the Platform, write to our Grievance Officer first (see below). We will try in good faith to settle it within 30 days.
Courts
These Terms are governed by the laws of India. Every dispute, claim or difference that is not resolved as above, whether between you and BrokerSaab LLP or arising from a tenancy, agreement, payment or deposit on the Platform, will be settled only by the competent courts at Pune, Maharashtra, which will have exclusive jurisdiction. The parties do not agree to settle such disputes by arbitration. This is subject to any mandatory rule that gives you the right to approach a consumer commission or another statutory forum. Nothing stops a party from approaching the police or a court for urgent relief or where the law requires.
22. Other services we may offer
BrokerSaab LLP may also offer other technology and professional services in future, for example software and web development, digital marketing, application testing and IT consulting. These are not part of the Platform. Each will be provided under its own written agreement or supplemental terms, and these Terms apply to it only where that agreement says so.
Using the Platform does not sign you up for any other service. We do not use the identity, tenancy or payment information you give us on the Platform to market other services to you without your consent (see our Privacy Policy).
23. Changes to these Terms
We may update these Terms as our services or the law change. We will post the new version with a new version number and date and, for material changes, notify you in the app or by message and may ask you to accept it again. If you keep using the Platform after the effective date, you accept the updated Terms.
24. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Platform.
- Severability. If a provision is found unenforceable, the rest remains in force.
- No waiver. A delay in enforcing a right is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours in a merger, acquisition or sale of business.
- Force majeure. We are not liable for failure caused by events beyond our reasonable control, such as natural disaster, outage or government action.
- Notices. We may notify you in the app, by SMS, email or by posting on the Platform.
